Annex 2 – Conditions consistent with the Operating Schedule

The Premises Licence Holder shall ensure that all staff members, in selling alcohol, at the premises shall receive the following induction training. This training will take place prior to the selling of such products: *The lawful sellingof age restricted products *Refusing the sale of alcohol to a personwho is drunk

Further verbal reinforcement/refresher training covering the above will be carried out thereafter at intervals not to exceed 8 weeks, with the date and time of the verbal reinforcement/refresher trainingdocumented.

 

All such training undertaken by staff members shall be fully documented and recorded and signed by both the employee and the DPS. All training records shall be kept on the premises and made available to Sussex Police, officers of the local authority and officers from the Trading Standardsteam upon request.

A list of staff members who are authorised to sell alcohol on the premises shall be kept. This shallbe endorsed by the DPS with the date such authorisation commences.

Prevention of Crime and Disorder:

 

A designated memberof staff will monitor the outside area when in use.

 

Persons will only be permitted to consume alcohol whilst seated or whilst waiting to be seated in the bar area.

 

Alcohol will be served by waiter/waitress serviceto persons seatedat tables only.

 

The opening hours as per part of the application will be an express condition of the licence although this condition shall not be construed as imposing any requirement on the premiseslicence holder to trade the totality of those hours.

Digital CCTV and appropriate recording equipment to be installed in accordance with Home Office Guidelines relating to UK Police Requirements for Digital CCTV System (PSDB Publication Number 09/05), operated and maintained throughout the premises internally and externally to cover all public areas,including the entranceto the premises.

 

The systemshall be on and recording at all times the premiseslicence is in operation.


 

The CCTV cameras and recording equipment must be of sufficient quality to work in all lightinglevels inside the premises at all times.

 

CCTV footagewill be stored for a minimum of 31 days.

The management will give full and immediate cooperation and technical assistance to the Police in the event that CCTV footage is required for the prevention and detection ofsuspected or allegedcrime.

 

The CCTV images will record and display dates and times, and these times will be checked regularly to ensure theiraccuracy.

 

 

 

 

 

Subject to GDPR guidance and legislation, the management of the premises will ensure that key staff are fully trained in the operation of the CCTV, and will be able to download selected footage onto a disk (or other electronic portable device acceptable to Sussex Police) for the police without difficulty or delay and without chargeto Sussex Police.

 

Any breakdown or system failure will be notified to the police immediately & remedied as soon as is practicable.

 

In the event of the CCTV system hard drive beingseized as evidenceas part of a criminalinvestigation by Sussex Police or for any other reason, the premises will be expected to install a replacement hard drive or a temporaryreplacement drive as soon as practicable.

 

Customers will not be permitted to take drinksoutside of the premises to consume whilstsmoking.

 

ForPublic Safety:

All parts of the premises and all fittings and apparatus therein, door fastenings and notices and the seating, lighting, heating, electrical, ventilation, sanitary accommodation, washing facilities and other installations, will be maintained at all times in good order and in a safe condition.

The requirements to comply with of The Regulatory Reform (Fire Safety)Order 2005 will be met.

All staff shall be suitably trained for their job function with the business. This will includelegislation relevant to their job role. The training shall be written into a programme of ongoing review and will be made availableto a responsible authority on reasonable request.

 

The premises licence holder will liaise with the Sussex Police during the development of the premises as to crime prevention and security measures and address any reasonable requirements identified.

 

 

For the Prevention of Public Nuisance:


 

Doors and windows will be closed except for access to and egress from the premises during any regulatedentertainment.

 

No noise shall emanate from the premises, nor vibration be transmitted through the structure of the premises whichgives rise to a nuisance.

 

No rubbish including bottles will be moved, removedor placed in outside areas between 23:00hrsand 08:00hrs.

The placing of refuse, such as bottles, into receptacles outside the premises takes place at times that will preventdisturbance to nearbyproperties.

Deliveries of kegs, bottles, food or other materials necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.

Forthe Protection of Children from Harm:

Age verification

A notice shall be displayed in and at the entrance to the premises where it can be clearly seen and read and shall indicatethat it is unlawful for persons under 18 to purchase alcoholor for any person to purchase alcoholon behalf of a personunder 18 yearsof age.

The premises will operatean age verificationpolicy set at a minimumof 21 years

 

(e.g. "Challenge 21") whereby any person attempting to buy alcohol who appears to be under the specified age e.g. 21 will be asked for photographic ID to prove their age. The recommended forms of ID that will be accepted are passports, official Photographic Identity Cards issued by EU states bearing a hologram or ultraviolet feature, driving licences with a photograph, photographic military ID or proofof age cards bearing the ‘PASS’ mark hologram.

Signage advertising the age verification or ‘Challenge 21’ policy will be displayed in prominent locations at the premises.

Suitable and sufficient signage advertising the “Challenge 21” policy will be displayed in prominent locationsin the premises.

 

The premises licence holder will ensure that all staff members engaged in selling alcohol on the premisesshall receive inductiontraining as to the lawfulselling of age restricted productsprior to the selling of such products, and verbal reinforcement/refresher training thereafter atintervals of no less than 8 weeks, with the date and time of the verbal reinforcement/refresher trainingdocumented.

 

All such training shall be fully documented and recorded. All training records shall be made available to the Sussex police and Brighton and Hove Council’s Trading standards Service upon request
